Not only haven't I been given any reason why my claims for Total disability stopped , but Paul Revere just sent me a premium notice dated for Feb 27....which, ofcourse, would put the policy into a lapse situation! All of you who are in a legal battle with them need to get this book. It is called: Disability Income Insurance: The Unique Risk 4th edition by Charles E Soule RHU who was the past president and CEO of Paul Revere. Library of congress Ca alog # is 97-77695 and the ISBN # is 1-57996-003-0 It can be purchased through the american college bookstore by credit card. Well anyway, it is suppose to be the textbook for the new HS-313 Disability course. Those of you with more money may wish to pay for the course and get all the materials. I could not afford to. But, anyway, I was shocked by this book. I sold this stuff nd taught the LUTC disability course and this book rambles about the problems of the industry and how the claims procedures are so subjective etc. Yet it is full of insight into the mindset of this company. And that is scary. Id discusses underwriting nd claims procedures. But interestingly enough, it goes on to say how the claims departments have established claim procedures and training and a very formal set of guidlines for their claims people to follow. Even to the follow up procedures. And they say they have no manual? For those of you in discovery his book says that only 3-5 % of all claims result in a personal contact from the company. I find this hard to believe because everyone in my condition has had an investigator at their house. It would be interesting to se what this % is for the mental & nervous disorders. Or the % for those with "own Occ" and lifetime benefits as appossed to other claimants. The quote that got me is" It is important ot remember that through its service, the claim department is the most accurate measure of the reliability and performance of the disability insurance contract." If this is true god help all of us. one of the most important messages I got from this book is not only what it says about the claims but what it doesn't say. Again, I haven't had time for further investigation, but this book hardly says anything about the doctor being the determinant as t who is or is not disabled, but that the company is. This really goes against anything I was taught. It seems as if this company and the industry has moved from treating the disability contact as a contract that pays a monetary benefit if your doctor s ys your disabled, but to a type of health care "benefit" provider. You lawyers read the Utilization provider review statues of your state. I believe a strong case can be made that these companies are behaving like a health care provider and as such should be regulated by the laws on the books for such. Their, management claim procedures can be found at the FHIPA web site www.fhipa.com I say it can be argued that their intrusion into "managing" claims is akin to HMO's and as such we the consumers do not have the protection of those laws because these companies have been exempted from them because the legislatures never anticipated that hey would cross the line in being a health benefit provider. I say their procedures and practices have placed them in the same category as the HMO's and as such should be regulated by the same laws. They have forced me to give them my psychaitric notes and all the notes from my other doctors so that they can pass judgement on whether I am disabled. Or in other terms used by the utilization laws, so that they can determine if my treatment is "medica ly nessecary" . And after they review them, they are going to determine whether I am disabled or not and either grant a continuance of my "benefits" or stop them. Even though my doctor says I am disabled. Yet from other I have heard from they arbitrai ily stop benefits. If they can be made subject to the utilzation laws, they have to file their procedures with the state. Also they must have procedures for reconsideration once they deny your benefits. Also they need to tell you in writing why they den ed your benefits. YET I hear from others that they refuse to do so. (My physician was shoc ed when I asked what he could have given the Company.) The newest claims rep, Joseph Griffin, felt the company did not need to respond in writing since they've written before. Funny, the last letter I have from them says, "Here are your benefits....in fu l..." I have had three claims reps in the last few months....Griffin was preceded by Holly Crawford, and she by John Cipro. This action comes on the heels of my filing police reports due to their having me followed, scaring me half out my wits in doing so on I-95; parking within my gated community to surveille my activities ; and, stalking me when with my 8 year old child. dditionally, their Field Rep, Sergio Cabanas, showed up at my home a few months back, and offered me a settlement of two bellydance costumes so I could embark on a new career of their choosing! For the record, I am a twenty (20) year veteran life and health insurance agent, with a backround in testifying as an expert witness in standards of practise, application, and statutes pertaining to insurance. I take Oriental Dance (bellydance to the une lightened) as a form of physical therapy. (It is one method of integrating left-right brain activity as needed to induce some of the hormones necessary to reduce some symptoms of the FM...it happens t be a recognized method used for healing thru the ages. I had recommended to Cabanas that the company support me in a trial of vitamin and enhanced physical therapy, since the implications are strongely documented and obviously helpful. However, the therapies cost approximately 1/3 of the benefits I had bee receiving. Traditional Physical therapy (under doctors care/ at his office/ massage/TENS/water therapy/etc) would cost more than 100% of my monthly benefit. Additionally, it can be proven that when a patient does the work- versus that done by the ther pists- more marked improvement is noted. Therefore, the impression I get from Paul Revere is that they wish to render me totally non-functional (like I was a few back, before engaging in these therapies) versus trying t use all my energies to reverse a c ndition that had me totally incapable of caring for myself. One company, sponsored by the Edmonton Chamber of Commerce was so full of holes that it was almost criminal that it should be sold at all. I eventually settled o Paul Revere because their policy was written in plain English and seemed to have no loopholes. As well, two non-affiliated life insurance agents told me that PR was the best disability insurance company around. I doubt I could have made a better choice i 1987. Obviously something has happened. Did their actuaries make a mistake in creating that balance between premiums coming in and benefits going out. Is the company in good financial shape? What would happen to their bottom line if they honoured their contract (and saved money from all this legal rigomoral)? If someone has this kind of info, we all could make a better decision. In 1997, the vehicle I was riding was rearended. I was pregnant at this time and the neck, shoulder and back injuries I had were exacerbated by the pregnancy. My own occupation policy states "You might be disabled from pregnancy or childbirth. If so, we will consider it to be the result of a Sickness." Provident cannot pigeon hole me into reporting income on a W-2. I reported income on a 1099 and paid taxes on earned income. So, they're classifying me as "unemployed with child care responsibilities." After paying my claim for 11 months under reservation of rights, for my Christmas present, my claims rep wrote me a letter asking for the money back. I think this is their way into "blackmailing" me into "never filing another claim again" or getting me to "turn my policy back to them." I believe they've used almost every dirty trick in their books to "make me go away" some of which insult my intelligence (I've never seen a passport before, could you make a copy of yours? Just ask me straight to my face that you want to know where I've een and for how long I've been gone. I was in the substance of the insurance business for almost 30 years....meaning, actively involved either in personal production (the majority of my career), Agency Management, and now fighting the same comp nies that I once represented with distinction. I have the industry recognitions that were awarded consistently to verify my production. (MDRT, LPRT, NQA, HIQA, NSAA) I acted as my own agent in acquiring my own policies. I bought the same CONTRACTS that I sold to my clients. The BEST products that were available at the time. I filed for disability benefits in July 1991. My claim, as I later learned from a company representative who was handling my claim, was called a DAM claim. I asked what that meant. He informed me that a DAM claim meant Drug, Alcohol, Mental related My diagnosis WAS and IS major depresssion and panic/anxiety disorder. My doctors have not waivered from their diagnosis. I was paid by General American Life Insurance Company, St. Louis, Missouri, benefits from July 1991 until July 1998. My benefits were ceased as a result of the IME GAME. Upon request from the company representatives, I submitted to four separate IME s (acronym and euphemism for INDEPENDENT MEDICAL EXAMINATIONS). How independent can they be when all such subsequent IME's are arranged, paid for, and questions to the claimant predetermined by the Insurance Company? The only INDEPENDENT Medical Examination that I ever recieved was from the first IME that included two doctors, one psychiatrist and one clinical psychologist. They determined me to be profoundly disabled. Not satisfied with that diagnosis, the ins rance companies sent me for more IME's until they could find ONE doctor who did not agree with all the others although he still thought I had a problem, he just didn't diagnosis it as clinical depression and anxiety but as an adjustment disorder. I was offered a buyout by General American in 1993. Based on the ridiculously low offer, I refused. Now my benefits have been denied. BOTTOM LINE: I was subjected to 4 separate IME's. Among these examiners were three separate psychiatrists and three separate clinical psychologists. In addition, I have my own doctors who have treated me for ten years (3 years prior to claim). Of hese doctors, seven have clearly stated that a psychological condition was and is present that disables me from performing my previous occupation. Number 8 says I have an Adjustment Disorder that disallows further consideration for disability benefits. OME RUN for General American. Only the last opinion counts. As a claimant, your only recourse is to sue. David vs. Goliath. Who do you think will win? In this case, ME. I have recently come into some resources that will allow me to fight the fight! During these arduous years I have accumulated a wealth of knowledge and information as to what you may expect as a claimant. We have heard other complaints about Revere/Provident attempting to DENY the policy provision which is the very basis of the coverage i.e. the ability to engage in any other employment while on own occ. disability benefits. One way they have tried to do this is by alleging that the client's NEW & ABLE occupation was the one being performed at time of claim. The client has the right to pursue another occupation though. They have been improperly requested on numerous occasions. First, if the only bjection to your claim is or was medical, then financial questions are WAIVED and the insurer has no right to request these or to seek them. In a Total Disability Claim, where your physician has stated you are completely unable to do any portion of your ccupation any longer, the benefit amount is not based on current income. That benefit amount for total disability is the amount listed on your payment schedule preset at time of approval of application and insurance underwriting. This is for Paul Revere Provident Own Occupation Disability Policies written from late 80's through early 90'3 pretty much prior to merger. Most complaints at this page deal with such time frames. A partial disability benefit amount is based on the amount of income being made thereby providing the insurer with a reason to request your income tax forms to determine how much you were making in order to set your benefit amount. Under Total Disability Benefits in an Own Occ. Dis. Policy by Revere/Provident, no right to tax forms would lie if the period of "incontestability" is past because the benefit level is preset on the date of application using the income level which the com any has underwritten and there is no ability to challenge statements made in the policy application after this period has run. In most states that period is two (2) years past the application date. Re: Greg Bretes ...atlawr. Payments made by Provident till 97 then I.M.E. then cutoff. Certain representatives of Provident have confidentially confided that Provident as an organization was not "bad" on the bad faith scale until Revere and their abusiv tactician claims department was merged with the company around the time you speak of. Then, Provident took on the M.O. of Revere, which was notorious to everyone but the unsuspecting insured with a newly filed claim. Regardless, occurrences at Revere & Provident around this time frame have a relationship apparently to both the conditions surrounding the D.I. market, the number of legitimate claims which Revere had requiring "claims reserves infusions" prior to the merger and the intial hiding of legitimate claims from the purchaser by the seller Revere, later discovered by Provident prior to acquisition. Provident apparently was willing to get a good deal on a failing ship with many flaws and a whole lot of claims liabil ties. They've got em now and I guess they're living with them and learning to love their practices. By the way, Provident insureds are the only ones screwed. Brokers have sued for breach of contract. I believe that paul revere feels, in time, most of the complaints against them will go away. I've heard as much as 70% stop ursuing them because of numerous reasons such as fed-up, lack of funds, death, etc.. the other 30% settle just before trial, go to trial and win, or go to trial and lose. The only time paul revere comes up a loser is when they get someone who has the stay ng power and wins in court. Unfortunetly, for the insured, this is a small percentage of the whole and paul revere's incentive is fight ever claim no matter how legitimate because 9 out of 10 times they come out better. They have attorneys all over the co ntry that specialize in defending against disability claims and company representitive's that do nothing but specialize at the trials. I feel sorry for the little guy who's been paying premiums, gets sick, can't work, and then finds out the insurance he elied on to support his family really doesn't exist unless he prepaired to do battle with GOLIATH. One of the lawyers who I have been in touch with, says they have information on the claims handling of the people at Provident. Some food for thought:: It is alleged that these people are paid by the number of claims they can deny. Also their anagers are paid this way also. If this is so,it has also been alleged that they are putting the cases"targeted" into an asset columun before they have actually ended the claims. Thus, I spent some time at the SEC website and all of the filings and repo ts on Provident and the merger are there. If all the alleges are true. (I don't doubt it but others might) Then by tying the claims peoples performance to claim denial, they are a guilty of stock manipulation. Since, they are moving cases out of "rese ve" status to an asset status this changes the value of the stock. Also on that web site, they have the documents that say that they do also give "performance" bonuses partially in stock. That would mean that by deny more claims they are increasing the alue of their own stock. Thus, I filed a complaint with the SEC suggesting they look into this matter. The President of Provident, Harold Chandler. The V.P. of Finance There are really a number in the corporate loop who regularly monitor the level of claims activity within the company and industry. Any official basically responsible for awareness of and response to greater expense side outflows compared to premium intake is theoretically in the organizational chart at a responsible level for what is being referred to as BAD FAITH DENIALS en masse. A COMPANY POLICY OF BAD FAITH toward insureds need not be stated, however. Organizational actions are the indicators of policies adopted. Where disabled or ailing insureds are: 1) Denied Response within appropriate time frames; 2) Denied Reasons for denials; 3) Given vague or changing reasons; 4) Systematically subjected to verbal abuse; 5) Informed that in-house physicians denying their claims will not be identified; 6) That internal memos relied upon to deny claims will not be released to insureds; then 7) There is an operational policy of bad faith through hiding out under vagueries and secreting of the information to which the contract holder is due. Keep in mind, this is a CONTRACT between the insured and the insurance company. Whether it was entered into or ultimately operated on by the Insurance Company in a Good Faith Manner is another matter. Yet, the insured party has a right to specific performance under the stipulations within the written contract. In addition, the contract holding insured has the same rights to reasonable interpretations under the policy as exists in the domiciled state where the policy was delivered and sold and underwritten.
